Course objectives
The aim is to acquaint students with the issue of copyright, the knowledge of which is essential for any user of the work or its author. The student has access to copyright not only in the language of the law.
Learning outcomes
After completing the course, the student will be able to:
- apply the basic principles of copyright to their own work;
- understand the essence and principles of collective copyright management;
Syllabus
  • • Introduction to the basics of law. Definition of basic legal institutes and terms. Legal branch. The system of courts and the basic principles of justice. The position of copyright in the system of national and international law. • Author's work. Legal features of the author's work. What is and is not a work - practical examples. Origin of the author's work. Author and co-author. • Personal rights. Definition of personal rights. Duration of personal rights. Protection of personal rights after the death of the author. Personal rights in practical examples. • Property rights. Definition of property rights. Legal features of selected property rights. Duration of property rights. Free work. • Free use of the work and legal licenses. Use of the work for personal use. Citation. A work placed in a public space. News license. Use of school work. Practical examples of the use of works without the need for the author's consent. • Author's work and the Internet. Making copyright works accessible on the Internet, the issue of so-called "copyright haevens". Downloading copyrighted works from the Internet. Persons responsible for copyright infringement on the Internet. Current cases. • Consequences of copyright infringement. Author's right to damages and unjust enrichment. Sanctions under copyright law. Criminal sanctions. Copyright infringement and their consequences on practical examples. • License. License agreement - definition, requisites. Exclusive and non-exclusive licenses, sublicenses. Employee work, school work. Special types of licenses. The issue of so-called free software. • The rights of performers, publishers, record producers and collective management. Special regulation of personal and property rights of performers, publishers, sound engineers. Collective management - concept. Collective managers - powers.
