Course objectives
The aim of the course is to introduce the fundamentals of systems of legal regulation of neighbouring countries with excursus to international law and community law including legal geography. The subject follows the course Legal System of the Czech Republic and is based on lightening of principle of differences between great legal systems, fundamental institutes of international law and background of comparison to legal order of the Czech republic, as well as lightening of functioning of legal systems of Slovakia, Poland, Hungary, Germany and Austria.
Syllabus
  • 1. Great legal systems. Legal geography. Continental legal system, Anglo-American legal system, Islamic law and some other law systems
    2. Aspects of international unification of law. Agents of unification, unification and culture, unification and comparative law, types of unification, content of unification, methods of unification, unification organizations, functions of unifications, national law and unified law, excursus to history of unification, current unifications.
    3. Fundamentals of international law. Concept and subject of international law, public and private international law, subjects of public international law, resources of public international law, responsibility and enforcement in public international law, international private law
    4.Fundamentals of community law. European integration after World War II. Law of European communities, separate areas of regulation EC and EU. Relation between intra-state law and community law.
    5. Legal system of the Slovak republic. Principles of constitutional law of the Slovak republic, Slovak judicial system, comparison of principal institutes of Slovak public law with law regulation in the Czech republic
    6. Legal system of Poland. Principles of constitutional law of Poland, Polish judicial system, comparison of principal institutes of Polish public law with law regulation in the Czech republic
    7. Legal system of Hungary. Principles of constitutional law of Hungary, Hungarian judicial system, comparison of principal institutes of Hungarian public law with law regulation in the Czech republic.
    8. Legal system of the Federal Republic of Germany. Principles of constitutional law of the Federal Republic of Germany, relation of federal states and country, German judicial system, comparison of principal institutes of German public law with law regulation in the Czech republic.
    9. Legal system of the Austrian Republic. Principles of constitutional law of the Austrian republic, Austrian judicial system, comparison of principal institutes of Austrian public law with law regulation in the Czech republic.
    10. Consular law and consular services of central European countries.
    11. Rudiments of law aspects of trans-border cooperation
