Course objectives
The aim of this course is to provide students with a comprehensive overview of family law, its position in the legal system and specific issues related to marriage, registered partnership, parenthood, child custody, children's rights and socio-legal protection of children. Students will be able to apply this knowledge to practical situations and resolve basic legal issues in the field of family law.
Learning outcomes
Upon completion of this course, the student will be able to: 1. Analyse the position of family law in the legal system and identify its key principles. 2. Explain the process of marriage formation, eligibility for marriage, and recognize obstacles to marriage. 3. Understand civil partnerships and unmarried cohabitation as alternative forms of relationship. 4. Describe community property and the processes of dissolution of marriage, including contested and uncontested divorce. 5. identify the legal aspects of determining parenthood, including maternity and paternity. 6. Explain the relationship between parents and children, including the protection of a child's personhood, name and surname issues, child custody, and child representation. 7. Apply the rights of the child, including international child protection law. 8. recognize and explain child support and concepts related to parental responsibility. 9. Discuss substitute family care, such as adoption, adoption of an adult, foster care, and placement in the care of another. 10. Explain the concepts of guardianship, custody, and child welfare, including the basic principles and provisions in this area. 11. Analyse the exercise of public administration in the field of social and legal protection of children and its significance in the context of family law.

  • The status of family law in the legal system Marriage - formation, capacity to marry, obstacles to marriage, marriage of convenience and nullity of marriage, obligations and rights of spouses, including spousal maintenance Registered partnerships, unmarried cohabitation Matrimonial property Dissolution of marriage; contested and uncontested divorce Determination of parenthood - maternity and paternity Parent-child relationship - protection of the child's personality, child's name and surname, care and protection of the child, representation of the child, care of the child's property Rights of the child, including international law protection of children Maintenance obligations Parental responsibility Alternative family care - adoption, adoption of an adult, foster care, fostering. Guardianship, custody, Social and legal protection of children - basic principles, measures and facilities for social and legal protection of children, exercise of public administration in this area

Small Credit - Active participation in lectures - Preparation of an essay on the chosen topic o The essay will be written by a group of students in a maximum of 5 students. o The topic of the group essay will be based on at least one scholarly article from abroad (not from Slovakia), which is related to the topic of the course; please prefer Web of Science or Scopus database. o The essay will be 4 standard pages. o Procedure:  1. Students will form groups.  2. They will agree on an article that will be the basis for their essay.  3. They will formulate a research problem based on their chosen article and add their practical experience.  4. They will submit their essay to the IS submission room by November 30, 2023.  5. The essay will be presented at the last lecture.  6. The presentation will be 10 minutes + discussion. o A maximum of 15 points can be earned for the essay and presentation. o Evaluation Criteria:  Topic Relevance: please select a topic that is timely and that provides insights that are useful to today's society.  Ability to engage with provocative theses: Find a topic that is interesting to others and that will pique their interest in the issue.  Implications for practice: Develop a topic that is practical and useful to others.  Presentations o Using AI in essay writing: AI can be used, but it is necessary to mention this fact in the essay. Please be careful that AI is not omniscient and makes quite a few mistakes. Thus, information from AI must be properly verified. Exam - The exam consists of 15 open-ended questions. - Each question is scored 1 point - The exam is written. - All printed study materials may be used for the exam. Overall assessment: 1. Essay - max. 15 points 2. 2. A - 27 - 30 points B - 23 - 26 points C - 20-22 points D - 17 - 19 points E - 13 - 16 points F - 12 points or less Erasmus If you are unable to actively participate in lectures due to participation in Erasmus, you can still successfully complete the course under the following conditions: 1. Essay - the above applies with the following changes: a. The essay is written by the student. b. The presentation will be made online at a time to be determined by agreement between the instructor and the student. 2. Written exam - date to be adjusted by agreement with the student.
