Článek se zabývá institutem asistenta sociální péče jako nástroje podpory setrvávání osob v jejich přirozeném prostředí. Úvodní část příspěvku se věnuje vymezení potřeb uživatelů a potenciálních uživatelů sociálních služeb a vybraným možnostem zjišťování těchto potřeb. Stěžejní část stati se zabývá institutem asistenta sociální péče a jeho legislativním ukotvením v právním systému ČR. Koncept zavádění asistenta sociální péče vychází ze skutečnosti, že některé potřeby lze saturovat jinými činnostmi, než je poskytování registrovaných – a často pro uživatele i zbytečně drahých – sociálních služeb. Článek se věnuje rovněž podmínkám poskytování služeb asistenta sociální péče a sociálním a kontrolním mechanismům jeho činnosti včetně problematiky přestupků a sankcí v této oblasti. Autor konstatuje dosavadní velmi malé rozšíření institutu asistenta sociální péče. Jako hlavní důvod tohoto stavu uvádí, že lidé závislí na pomocí jiných osob dávají přednost registrovaným sociálním službám, které pokládají za profesionálnější a lépe kontrolovatelné.

The article addresses the engagement of social care assistants as a tool to support individuals remaining in their natural environment. The introductory part of the paper is devoted to defining both the needs of users and potential users of social services and options for identifying such needs. The main part of the paper addresses the institute of the social care assistant and the legislative anchoring thereof in the Czech legal system. The concept of introducing social care assistants is based on the fact that some needs are often overwhelmed with activities other than the provision of registered - and often for the user unnecessarily expensive - social services. The article also considers the conditions relating to the provision of social care assistant services and the social and inspection mechanisms that direct such activities, including the issue of violations and sanctions in this area. The author notes the very limited expansion of the institute of social care assistants to date, the main reason for which is that persons who depend on assistance from others tend to prefer registered social services, which they consider to be more professional and accountable.
