- Course objectives
- The course comprises the presentation of philosophical and historical way outs of alternative solutions of criminal affairs and concept of restorative justice. The students will be explained the elementary terms, used in probation and mediation and the law frame of usage of alternative processes in the frame of probation activities and alternative punishments will be presented, including international comparison of probation and mediation systems in context of European Union. The students will gain theoretical knowledge and practical skills of Probation and Mediation Service as a specific field of social work, they will learn the base, theoretical way outs and possibilities of use of mediation in alternative mediation of conflict solving connected to criminal activity. The course is closely connected to courses law, social work and social policy. An important part of the course will be the presentation of the organizational structure and the requirements on staff expertise of this state organizational division and also the co-operation of the Probation and Mediation Service with law enforcement authorities and the Prison Service of the Czech Republic. An integral part of the course is also the presentation of a comprehensive system of post-penitential social welfare in the Czech Republic. Study Outcomes: Professional Knowledge: Participants will acquire theoretical knowledge of the activities of Probation and Mediation Service as a specific area of social work using extensively the legal professional base of criminal law. They will also acquaint themselves with the essence, theoretical background, and the possibilities of the use of mediation as an alternative conflict resolution related to crime. Professional Skills: Students gain knowledge of the practical procedures of probation and mediation activities intended for the released people from imprisonment and of other procedures used in the post-penitential social care practice. They are reliably familiar with the relevant field literature, can locate, interpret and apply the gained information in practice. Passing this course, they become able to integrate the acquired knowledge to the needs of the practice in the field. General Qualification: Students can comprehend the context of task execution in post-penitential practice in the Czech conditions. Passing the course of probation and mediation particularly enables students to adapt easier to the performance of professional activities of a Probation and Mediation Service assistant and of a post-penitential social care officer. Methods of the course will encourage the development of critical thinking, creativity and the students' ability to make decisions independently and responsibly.
- Syllabus
- 1. Philosophical way outs of alternative solution of criminal affairs, term delimitation
2. Base and meaning of alternative punishments, historical development of mediation of alternative solving of criminal affairs. Overall approach, alternative solution of criminal affairs in the system of criminal law
3. Law frame of alternative solving of criminal affairs - constitution-law, subject-law and process way outs; criminal law, criminal order, act on Probation and mediation service
4. Offence, concept of offense as a conflict, Offender and victim. Coactions of Probation and Mediation service with organs active in criminal process
5. Law consequences of offence, punishments and defensive policies. Punishment, function of punishment, importance of punishment, types of punishment, the course of various sentence
6. Subject-law alternatives for punishment, alternative punishments. Various types of alternative punishments connected with probation activity. Comparison of practice in the Czech republic and other European countries.
7. Methods of work of probation activities, concepts of control and help, social services in criminal justice. Processing of base for authorities active in criminal process
8. Issue of parole. Work with sentenced to imprisonment, preparation for decision regarding conditioned release
9. Alternative means of solving criminal affairs and deviations from standard criminal process. Comparison of practice in the Czech republic and other European countries.
10. Mediation as alternative form of fulfilling of criminal justice. Base of mediation, possibilities of use, structure of mediation process in criminal process, mediation way outs. Composition of base for authorities active in criminal process.
11. Accused and aggrieved in process of alternative solving of criminal affair. Peculiarities of work in the frame of compensation for custody
12. Specifics of work of probation of clerk with adolescents and under age
13. Summary
Seminar
The seminar develops basic skills relevant to the practice of probation and mediation activities. Students will present case studies which will be enabled to them by (the Silesian University in Opava associate) organizations incorporated in the system of post-penitential care in the Czech Republic - especially the Probation and Mediation Service. Active participation in seminars is required which is assessed based on relevant suggestions regarding the presentations of other students.
