Course objectives
The course aims to introduce students to non-directive and relational approaches to conflict intervention, particularly through mediation. Students will gain knowledge of the historical development and different models of mediation and be able to analyze conflicts from the perspective of mediators. The course emphasizes transformative mediation and values such as empowerment and recognition as key aspects of effective and ethical mediation.
Learning outcomes
Upon successful completion of this course, students will be able to: - Distinguish between different models of mediation (facilitative, evaluative, narrative, transformative) and explain their key differences. - Understand the concept of "grand narratives" of conflict (narratives of rights, power, interests and relationships) and how they relate to mediation approaches. - Explain the principles of relational approaches in the helping professions and their application in transformative mediation. - Identify ethical dilemmas and value conflicts in conflict resolution and propose ways to resolve them according to the principles of transformative mediation. - Apply an interaction filter to analyze conflict and identify the weakening of empowerment and recognition between participants. - Apply the principles of non-directive conflict intervention and understand the key roles of a transformative mediator. - Practice the techniques of reflection, summarizing, checking-in, and refraining in conflict interactions.
Syllabus
  • 1. Mediation models and mediation approaches - historical development and conceptual differences - Students will understand the differences between facilitative, evaluative, narrative, and transformative approaches to mediation 2. The concept of conflict in dispute resolution - the 4 grand narratives (story of rights, power and oppression, interests and needs, relations) - Students will be able to explain how each story relates to the central values of mediation approaches 3. Relational approaches in the helping professions and their application in transformative mediation - Students will be able to explain the nature and principles of relational approaches in the helping professions and their reflection in transformative mediation 4. The influence of value anchoring for conflict resolution - ethical dilemmas of transformative mediation - Students will be able to identify values that conflict in selected model situations - Students will be able to suggest how a given ethical dilemma should be resolved in accordance with the principles of transformative mediation 5. Empowerment and recognition as landmarks for conflict intervention - Students will understand the dialectic of the concepts of relational empowerment and relational recognition, or relational weakness and relational self-centeredness - Students will be able to apply an interaction filter to an ongoing conflict interaction and identify the weakening of empowerment and recognition between participants 6. Definitions, goals and outcomes of transformative mediation - Students will be able to describe the identifiers of constructive conversation from a relational perspective - Students will be able to explain the difference between the goals of the mediation participants and the goals of the mediator 7. Non-directive concepts of conflict intervention - the role and responsibility of the mediator - Students will be able to explain what the role of the transformative mediator is and what his/her responsibilities are in intervening in the parties' conflict interaction 8. 3 key activities of a transformative mediator - identifying opportunities, maintaining purpose, responding - Students can identify opportunities in the parties' conflict mediation interaction to promote constructive conversation between the parties 9. 4 interventions of the transformative mediator - reflection, summarizing, validating, refraining - Students can explain the purpose and process of conducting each intervention - Students can demonstrate the use of each intervention in model situations

Teaching methods
- Presentation and discussion - Analysis of video recordings from the mediation - Role-playing in model situations - Group work focused on solving case studies - Reflection and self-assessment of mediation skills
Assessment methods
Active participation in class: credit will be awarded based on active participation in discussions and group work - 90% participation required. Mediation Analysis: Students will analyze a videotaped mediation and provide feedback with respect to the values of empowerment and recognition. Practical Exam: Students will demonstrate mediation skills in model situations where they will be evaluated on their ability to use the intervention (reflecting, summarizing, validating, abstaining). Alternative assignment: Students will write an essay in which they analyze the ethical dilemma of the conflict mediator and propose a solution in accordance with the principles of transformative mediation.
