- Course objectives
- The students will be presented the historical background and roots of European integration processes from post-war period till present day. The fundamental part of the course represents legal embodiment of institutional structure of European community and especially substantial secondary law expressing aims of key common and coordinated policies of European Union, counting also the second and the third pillar of EU, i. e. internal affairs and justice (including Schengen Area and European order for arrest), security and foreign policy and on the edge also proposed defence policy. The students will then know both institutional frame of EU and will orientate in wider connections of European integration including position of EU in international relations. They will gain systematic knowledge of fundamentals of European law, priorities of common and coordinated policies which are embodied legally and finally an outline of unavoidable fiscal questions of European monetary system.
- Syllabus
- Outline of taught topics:
1. Social-political causes of the origin of integration processes after World War II and its legal frame
2. Primary European law in dynamics of its development. Constitution for Europe and so called Lisbon Treaty
3. Institutional dimension of European union, legislative initiation, legislative procedure, Elections to European parliament
4. Common policies of EU, general reasons of their implementation, legislative frame of realization and their priorities in dynamics of current changes
5. Coordinated European policies, legal frame of their implementation, energetic chart, European social chart.
6. Secondary law of European Union, intensity of effect on member countries, circle of subjects authorized to their edition, publication, notification
7. Fiscal frame of European Union, creation and approval of budget, budget and monetary priorities, intervention of European central bank, harmonization of tax issues in European Union
8. European monetary system. Competences of European central bank, characteristics of legally embodied criteria of convergence for entering eurozone
9. Schengen system, European order for arrest and conditions for its release, circle of subjective aspects of offences in proceedings authorizing release of European order for arrest, proceedings regarding prejudicial question, European citizenship, Europol, extradition proceedings.
10. Legal frame of united internal market, I., II. and III. pillar of European Union, Lisbon strategy, European Union and its position in international relations, priorities, institutional level
11. European law of commercial companies, societas europea, cartel agreements, legal regulation of fusions
12. Cohesion fund, structural funds of European Union, structure, administrative and legal rules of drawing, regional operational programmes, scope of authority of central organs of public administration and regions in realization of projects
