Course objectives
Course builds on the knowledge gained in the quoting of the subjects of law and public administration, when the subject is the interpretation of one of the public administration system, and that the procedural steps in the exercise of State administration. Passing of the course will allow students to acquire knowledge about the function of public administration,which carrying out public authorities, public corporations and legal and natural persons authorized by the State at central and territorial level in execution of state administration.
Learning outcomes

After completing the course, the student understands the basic concepts of administrative law and public administration and is able to distinguish between state administration and self-government. He/she understands the position of administrative law as a branch of public law and the principles of the administrative law method of regulation. He/she is familiar with the sources of administrative law, their hierarchy and basic types of norms. He/she knows the basic principles of the performance of public administration and administrative proceedings, subjects of administrative law and administrative law relations. He/she is able to describe the methods and forms of public administration activity, the basic institutes of administrative punishment and public administration control. The student is familiar with the course of administrative proceedings, distinguishes between types of administrative decisions and remedies and is able to apply basic procedural rules when solving simple practical tasks.

Syllabus

  1. Public administration and administrative law (definition of the terms administrative law, public administration, state administration, self-government).
  2. Administrative law - general characteristics (general definition of administrative law, administrative law as a branch and its position in the legal system, administrative-legal method of regulation)
  3. Sources of administrative law (generally binding normative administrative acts, concept and types of sources of administrative law, their classification and characteristics, publications of sources of administrative law).
  4. Administrative law norms (classification of administrative law norms, scope, implementation, interpretation of administrative law norms).
  5. Basic principles of public administration (principles of good administration, principles of public administration performance, principles of administrative procedure).
  6. Subjects of administrative law (executors and addressees of public administration).
  7. Administrative legal relations (prerequisites for the establishment, characteristics, elements, types).
  8. Methods and forms of public administration performance (methods of operation, forms of public administration activity).
  9. Administrative punishment (misdemeanor, other administrative offense, disciplinary offense).
  10. Control of public administration (parliamentary, SAO, judicial, administrative authorities, citizens, Public Defender of Rights).
  11. Administrative proceedings I. (participants, initiation, communication administrative authority-participant of the proceedings, evidence, decisions).
  12. Administrative proceedings II. (decisions - types, requirements, legal power, enforceability).
  13. Administrative proceedings III. (remedies - ordinary, extraordinary, requirements, deadlines).

Teaching methods

Lectures are interactive. During the lectures, discussions are held on individual legal topics and problems are demonstrated in working with legal regulations.

Skills demonstration
Assessment methods

Continuous test (20%), preparation of a procedural document (10%), written exam (70%).
