Course objectives
The aim of the subject of Public Administration is to establish on the knowledge gained in the subject of law and constitutional law in particular. To acquaint students with the functioning of State administration and territorial self-government in the Czech Republic and in the management of public administration, including the administration of the judiciary. From the perspective of practice then to obtain knowledge about the activities of the organs of State administration, public corporations in the scope of the delegated authorities.
Learning outcomes
The student will be able to explain the basic concepts, principles and functions of public administration in the Czech Republic, distinguish between state administration and self-government and clarify their constitutional anchoring, mutual relations and the position of the citizen in public administration. He will be able to analyze the organization of public administration, describe the scope and powers of central administrative authorities, territorial self-government units and indirect executors of public administration. He will be able to distinguish and evaluate the forms of public administration activity, especially normative and individual administrative acts, public contracts and other acts with legal consequences. He will be able to explain the legal regulation of the municipal and regional system, describe the bodies of municipalities and regions, their independent and delegated powers and the rights of citizens of territorial self-government units. He will be able to describe the position and obligations of officials in public administration, apply the basic rules of legal regulation of their activities and understand the principles of their education. Furthermore, he will be able to explain the basics of public administration management, the relationship between the state budget and the budgets of territorial self-governing units and the principles of financial management in public administration. He is able to analyze the system of public administration control, including internal and external control, administrative supervision, judicial and parliamentary review, the role of the public defender and the right to information. Last but not least, he will be able to describe the principles of European public administration, explain their influence on the Czech administrative system and interpret the European principles of subsidiarity, proportionality and regional policy, including the NUTS system.
Syllabus

1. Public administration in the Czech Republic


Course content and structure, the importance of public administration in the Czech Republic, the role of public administration in the legal system. Basic sources of legal regulation. The nature of state power and self-government, their mutual relationship. The position of the citizen in the public administration system. The constitutional basis of legislative, executive and judicial power in the Czech Republic and their relationship to public administration.


2. Public administration activities


The nature of public administration activities in relation to citizens. Forms of this activity, in particular normative administrative acts, individual administrative acts, public law contracts and other negotiations in public administration with legal consequences.


3. Organization of public administration


Principles of the organization of state administration and self-government. Organization of central state administration bodies (ministries and other central administrative offices). Territorial division of the state for the purpose of exercising state administration. Indirect executors of public administration. Constitutional foundations of self-government.


4. Municipal and regional system


Basic characteristics of municipal and regional systems. Sources of legal regulation. Territorial, personnel and self-governing basis of a municipality and a region. Rights of citizens of a municipality and a region. Exercise of independent and delegated powers. Power to issue normative administrative acts. Municipal and regional bodies.


5. Workers in public administration


Officials of territorial self-governing units, state officials. Legal regulation of the status of officials. Rights and obligations of officials. Education of officials.


6. Management in public administration


Legal regulation of management in public administration. State budget and its relationship to the budgets of territorial self-governing units. Financial management of territorial self-governing units.


7. Control and supervision in public administration


The concept of control and its mission in public administration. Internal and external control, administrative supervision. System of control of public administration in the Czech Republic. Functions of the Supreme Audit Office, administrative judiciary, Constitutional Court, Public Defender of Rights and other specialized control bodies. Publicity and the right to information. State supervision over the exercise of local government.


8. European public administration


Definition of the European administrative area and the relationships that arise within it. Principles of subsidiarity and proportionality. European regional policy and territorial division of the Czech Republic into NUTS statistical units. European Charter of Local Self-Government as the legal basis for territorial self-government in Europe.

Teaching is conducted in an interactive manner, applying practical knowledge from the lecturer's many years of experience in the subject matter, as well as the students' personal knowledge. Emphasis is placed on discussions on individual lectured topics.
