- Course objectives
- The aim of the course is to familiarize students with the history and significance of European economic and political integration, the institutions of the European Union, the sources of European Union law, the adoption of European Union legislative acts, the preliminary ruling procedure, the enforcement of EU law or other types of actions resolved before the Court of Justice of the EU. Students will gain a comprehensive view of the fundamental European freedoms of movement of goods, persons, services and capital.
- Learning outcomes
- The student is able to analyze the founding and amending treaties of the EC/EU. The student is able to define and apply the principle of supranationality and the principle of subsidiarity and to evaluate the birth of European integration. The student is able to evaluate the powers of the European Commission, the Council, the European Council, the European Parliament or the Court of Justice of the European Union, as well as to state their composition. The student is able to analyze primary and secondary law of the European Union, as well as acts of secondary EU law: regulations, directives, decisions, recommendations and opinions. The student is able to determine what the proper legislative procedure is and how it works. The student is able to analyze the institute of enforcement of EU law and the institute of preliminary ruling proceedings. The student is able to evaluate the EU internal market and the four fundamental freedoms of this market (free movement of goods, persons, services and capital). The student is able to analyze the EU trademark, primary and secondary freedom of establishment and the essential differences between the free movement of services and the freedom of establishment. The student is able to discuss labor law in the EU and social security in the EU. The student is able to evaluate the objectives and principles of environmental protection policy in the EU, can analyze the EU eco-label. The student is able to analyze the issue of abuse of dominant position in the internal market in the EU or state aid incompatible with the internal market in the EU. Furthermore, the student is able to determine essential information regarding the protection of consumer safety and health in the EU, what protection consumers have in the case of distance contracts and contracts concluded outside business premises and what are unfair terms in consumer contracts in the EU.
- Syllabus
- 1. The concept of EU law. European integration and the establishment of the European Communities. The European Union. Introduction to the history of the EC/EU, the founding and amending treaties (Treaty of Paris, Treaties of Rome, Merger Treaty, Single European Act, Maastricht Treaty, Amsterdam Treaty, Treaty of Nice, Lisbon Treaty) and their most important provisions, the principles of supranationality and subsidiarity.2. Institutional law of the European Union. The most important EU institutions: Commission, Council, European Council, European Parliament, Court of Justice of the EU and their powers.3. Sources of EU law. Relations between institutions, law-making, ordinary legislative procedure. Categorization of EU law, primary law, secondary law (especially regulations and directives), case law of the Court of Justice of the EU, power of EU institutions to create legislation, ordinary legislative procedure.4. Enforcement of EU law. Other types of actions decided before the Court of Justice of the EU. Proceedings against a Member State that has breached an obligation laid down by EU law (proceedings before the Commission, stage of legal proceedings before the Court of Justice, sanction for a state that does not comply with a judgment of the Court of Justice). Francovich judgment. Action for the annulment of an act of an EU institution. Action for failure to act of an EU institution. Action for damages against the EU.5. Interpretation of European Union law. Ensuring a uniform interpretation of EU law. Preliminary ruling procedure (preliminary ruling) – concept, subject matter of the procedure, optional and mandatory initiation of preliminary ruling procedure. Significance of preliminary ruling procedure.6. Internal market of the European Union. Free movement of goods. EU trademark. Free movement of persons. Freedom of establishment. Labour law in EU law, coordination of social security at EU level. Free movement of services. Free movement of capital and payments. Case law on the free movement of goods, persons, services and capital.7. Other areas of regulation of European Union law. Competition in the EU. Public procurement law in the EU. Environmental law in the EU. Consumer protection in the EU. Regulation of state aid.
