Abstract
There is, within broader political circumstances, explained the legislative process leading to the adoption of the new Civil Service Act in the Czech Republic, in the paper. The author defines, in his opinion, most important problems associated with the adoption of the Civil Service Act in the Czech Republic. The author draws attention to the fact that there has not yet been completed the reform of public (state) administration at central level and also that there has not yet been approved any specific legislation for state employees in administrative offices and other employees in administrative offices from the 90s. Regarding the content of the Act, the author points to the existence of so-called political deputy of minister who does not have entrusted management of any section in the organizational structure of the ministry. The paper explains the most controversial points of the Act that, among other things, led the President of the Czech Republic to exercise his right to file a constitutional complaint. Despite the president's constitutional complaint, the Act no. 234/2014 Coll., the Civil Service Act is now a valid part of the Czech legal order.
