The paper analyzes the position of economic, social and cultural rights as part of the institution of fundamental rights and freedoms in a democratic state, including their connection to the economic power of the state, its economic and social policy. The author characterizes economic, social and cultural rights on a general level based on their legal regulation in international documents on human and civil rights, points out the specifics of the constitutional enshrining of this group ofrights, pays special attention to their availability in accordance with the provisions of the Constitution of the Slovak Republic. In the end, he formulates the possibilities of developing the second generation of human rights at the constitutional and socio-political level.
