- Course objectives
- The aim of the subject is to gain a basic insight into the issues of criminal and misdemeanor law with profiling in relation to the topic of the completed study program.
- Learning outcomes
- The acquired skills will consist in understanding the structure of administrative infraction and criminal law and the basics of legal responsibility in the mentioned areas. The student should be able to: - when performing social work, distinguish which moments may be associated with criminal or administrative liability; - appropriately subsuming the events under the relevant legal norm; - assess possible borderline situations from the point of view of circumstances excluding illegality; - to distinguish situations in which administrative delicts or crimes are clearly being committed. The graduate of the subject will be prepared for in-depth work with the topic.
- Syllabus
- 1. The essence of administrative and criminal liability, the position of administrative punishment and criminal law within the legal system of the Czech Republic; 2. Development of criminal and administrative infraction law from a historical perspective; 3. General part: Basic prerequisites of criminal and administrative delict liability, elements of administrative delict and criminal acts; 4. General part: Applicability of the law, perpetrator of the administrative delict and criminal act; 5. General part: Prerequisites of responsibility for committing a crime and an administrative delict; 6. General part: Circumstances excluding illegality, lapse of the delict and criminal act 7. General part: Juveniles as perpetrators of administrative delicts and crimes 8. Special part: Criminal acts in the field of social work, criminal law reaction to the phenomenon of domestic violence 9. Special part: Offenses in the provision of social services 10. Criminal procedural law - legal regulation and basic institutes 11. Administrative procedural law - legal regulation and basic institutes 12. Summary of the course, development perspectives, the importance of criminal and administrative repression
