Course objectives
The course introduces students to international law. Students will be able to define public international law and private international law, students will get acquainted with the subjects of public international law, the international legal status of states, the law of international organizations, international treaty and international disputes under public international law. Students will be able to define the concept, subject and sources of private international law, conflict of law rules of family law, conflict of law rules of succession, conflict of laws rules in rem, conflict of laws rules on obligations. Students will also know the basics of private international procedural law and international trade law, within this branch of law students will be able to define the subjects of international trade, regulation of international trade or the international purchase of goods. Last but not least students will get acquainted with some disputes in international trade.

Syllabus
  • 1. Definition of international law. Division of international law into public international law and private international law. Sources of international law, international treaties, general legal principles, case law. 2. Fundamentals of public international law.
    Specifics of public international law. Subjects of public international law (state, international organizations), international legal status of states (state and its elements, origin, extinction and types of states). International legal status of the population, individuals and the protection of human rights. Law of international organizations).
    3. International treaties and international disputes under public international law. Definition of international treaties. Specifics, classification, origin, validity, concluding, change and revision of international treaties. Reception of international law. The law of peaceful settlement of international disputes. International responsibility. International crime.
    4. Fundamentals of private international law. Private international law, concept, subject, sources. Subjects and legal proceedings. Conflict of law rules of family law. Conflict of law rules of succession. Conflict of laws rules in rem. Conflict of laws rules on obligations.
    5. Private international procedural law Jurisdiction of the court in proceedings with an international element. Recognition and enforcement of foreign decisions. Legal assistance in contact with foreigners. Arbitration. Case studies.
    6. International business law. Introduction to international trade law. Subjects of international trade. International trade organizations. Regulation of international trade. International purchase of goods. Procedure for concluding a purchase contract. Content of the contract. Rights and obligations of the contracting parties to the purchase contract. Breach of contract, legal consequences, liability for breach of purchase agreement. Incoterms.
    7. Dispute resolution in international trade. Alternative methods of dispute resolution. Judicial proceedings. Arbitration. Case studies.
