- Course objectives
- The aim of the course is to acquaint students with the legal regulation of employment-law relations. The teaching is focused on the methods of creation, change and termination of the employment relationship, on the rights and obligations of employees and employers arising from the employment relationship, including the position of trade unions in labor and legal relations, issues of remuneration, creation and compensation of damages and other institutes of labor law. The interpretation is currently supplemented by the position of state officials and officials of territorially correct units in labor and legal relations.
- Learning outcomes
- The student will be able to explain the system of labor relations in public administration, distinguish the position of employees of territorial self-governing units, state employees and other public administration employees and clarify the role of trade unions in labor relations. Furthermore, he will be able to describe the sources of labor law in public administration, characterize the relationship of the Labor Code, the Civil Service Act and the Act on Officials of Territorial Self-Governing Units and explain the meaning of internal regulations of service offices. He will be able to analyze the civil service as a specific legal regime, define the scope of the Civil Service Act, the position of service offices and the specifics of the service relationship. He will also be able to describe labor relations in delegated authority, the position of heads of offices, senior officials and officials and distinguish between administrative and service activities. He will be able to explain the establishment, change and termination of service and employment relationships in public administration, characterize the procedure in matters of service relationships and assess the rules for selecting employees and their training. Furthermore, they will be able to explain the legal regulation of working hours and rest periods in public administration, including the distribution of working hours, breaks, holidays and reimbursement of expenses. They will be able to analyze liability for damage in employment relations, distinguish between the liability of the employee and the employer and describe the rules for compensation for damage. Last but not least, they will be able to explain the principle of equal treatment and the prohibition of discrimination in employment relations in public administration, identify forms of discrimination and assess the available means of legal protection.

- 1. Public administration public administration employees of the Czech Republic
- Public administration system and entities performing public administration. Characteristics of labor relations
- in public administration. Entities of labor relations, incl. the position of unions and other entities representing employees in public administration.
- 2. Sources of labor law in public administration
- Historical milestones in the development of labor law in public administration and civil service. Current legal regulation of labor relations in public administration. Characteristics and relationship of labor codes, the Civil Service Act and the Act on Officials of Territorial Self-Governing Units. The importance of internal normative acts in civil service offices (service and labor regulations).
- 3. Civil service and service relationship
- Scope of the Civil Service Act - positive and negative definitions. State office, civil service office, civil servant, superior, place of service of a civil servant. Specifics of service relationship in the system of labor relations.
- 4. Devolved state administration and employment relationship
- Scope of the Act on Officials of Territorial Self-Governing Units – positive and negative definitions. Office, position of the head of the office in labor relations, senior officials, officials and other employees of territorial self-governing units. Performance of administrative and service activities.
- 5. Establishment, change and termination of service and employment relationship in public administration
- Characteristics of performance of dependent work in service and employment relationship. Employment law eligibility, service designation in the civil service. Proceedings in matters of service relationship Selection of public administration employees and their further education. Decision on admission to service relationship and employment contract. Change and termination of service and employment relationship.
- 6. Working hours and rest periods
- The concept of working hours and its development. Working hours and their distribution. Basic, reduced and shorter working hours. Work regime. Uniform and uneven distribution of working hours. Records related to working hours. Rest periods. Breaks at work. Annual leave and leave for days worked. Expense reimbursements provided to employees in connection with the performance of work.
- 7. Liability for damage in employment relations in public administration
- Definition of the term damage and its occurrence in an employment relationship. Liability for damage on the part of the employee and employer, compensation for damage.
- 8. Equal treatment and prohibition of discrimination in employment relations in public administration
- Definition of the terms equal treatment and discrimination. Scope and content of the legal regulation. Forms of discrimination in employment relations. Means of protection against discrimination.
